Complete Guide to Gold Taxation in India: LTCG, STCG, and 3% GST Rules

Executive SummaryThe Union Budget 2024 introduced structural revisions to precious metals taxation. Customs duty was lowered to 6%, while the holding period for Long-Term Capital Gains was reduced from 36 to 24 months at a flat 12.5% rate. Here is an overview of the legal tax framework.
Research & Analysis: IPMEX Bullion Research Desk

01.Key Structural Reforms in Precious Metals Taxation

Effective July 23, 2024, the Ministry of Finance rationalized the customs duty and capital gains provisions applicable to gold, silver, and related financial assets. The reforms aimed to reduce illicit imports and establish parity across asset classes.

02.Comparison: Prior vs Current Tax Provisions

The updated provisions for physical precious metals investments:

ProvisionPrior Regime (Pre-July 2024)Current Framework (Post-Budget 2024–2026)
Basic Customs Duty15.0% (inclusive of AIDC and cess)6.0% total import duty
LTCG Qualification PeriodHolding period exceeding 36 monthsHolding period exceeding 24 months
LTCG Tax Rate20.0% with indexation benefits12.5% flat (without indexation)
STCG Tax Rate (Under 24 mo)Applicable income tax slab rateApplicable income tax slab rate
GST on Bullion Purchases3.0% uniform nationwide3.0% uniform nationwide
Domestic Price Impact
The 900-basis-point cut in customs duty reduced the baseline domestic cost of gold bullion by approximately Rs 4,500 to Rs 5,000 per 10 grams, bringing Indian market prices into closer parity with international spot benchmarks.

03.Capital Gains Computation Rules

### 1. Short-Term Capital Gains (STCG) If physical bullion bars, coins, or digital holdings are liquidated within **24 months of acquisition**, realized gains are categorized as short-term capital gains: - **Tax Rate**: Added to aggregate taxable income and taxed at the investor's applicable marginal income tax slab.

### 2. Long-Term Capital Gains (LTCG) When physical bullion is held for **longer than 24 months**: - **Tax Rate**: A flat **12.5%** on net capital gains. - **Indexation**: The Cost Inflation Index (CII) adjustment has been removed. Capital gains are calculated as: *(Net Sale Consideration - Acquisition Cost - Transfer Expenses) × 12.5%* plus applicable surcharge and cess.

04.Invoicing Standards and Regulatory Verification

All legitimate precious metals acquisitions attract a **3% Goods and Services Tax (GST)** applied to the underlying metal value and minting charges.

Purchasing un-invoiced bullion exposes individuals to scrutiny under Section 69A of the Income Tax Act (unexplained investments), which carries penalty rates exceeding 78%. Legitimate digital and physical purchases on platforms like BullionKart generate itemized GST invoices tied to PAN or Aadhaar verification, creating documented proof of legal title.
